The family of murdered 12-year-old Sibusiso Dakuse of Hout Bay said they were disappointed that the accused, Marvin Minaar, had made a 180-turn in the case after pleading not guilty to the charges.

Since last year, Minaar’s legal team and the State have been pursuing a plea agreement.

This morning, when Minaar’s trial began at the Cape High Court, he pleaded not guilty.

In 2020, soon after Minnaar’s arrest for his basketball student’s murder, he made a confession.

In the Wynberg Magistrates’ Court, the court revealed that Minaar had been caught on CCTV footage as being the last person to have walked with Sibusiso before he was found dead.

Minaar is believed to have lured Sibusiso after he left his home on February 26, 2020, and took him to Kronendal Farm.

His body was later discovered among the reeds on the farm.

Eric Ntabazalila of the National Prosecuting Authority confirmed the trial was on the court roll.

Sibusiso’s aunt, Thabisa Dakuse, told Weekend Argus this morning that the family had disappointment at the start of the trial but was happy that it had begun.

“It is an emotional day for us because the trial has finally started, and at least we have that relief.

“What is discouraging for us is that Marvin Minaar is not pleading guilty.

“He had a chance to open his own mouth. He was asked for three times and he said he will not be pleading guilty to rape and murder and kidnapping.

“It is painful, but at least the trial will be continuing for the week.”
